CONTEST RULES

LOULOU magazine

The sponsors of the IT GIRL contest are LOULOU magazine, a division of Rogers Publishing Limited ("Rogers"), and Reitmans (Canada) Limited (owner of the "Smart Set" division) (hereinafter collectively called the "Contest sponsors"). By entering the contest, all entrants accept the terms and conditions of the present rules and agree to be bound by them.

  1. The IT GIRL contest (the "contest") begins at 12:01 a.m. on February 20, 2009 and ends at 11:59 p.m. on May 21, 2009. No purchase is necessary to enter the contest. Any attempt or suspected attempt to enter more than once per person, any use of robotic, automatic, programmed or entry methods not authorized by these rules, shall be deemed as tampering and will void all of your entries.  All times refer to Eastern Standard Time. Contest is void where prohibited by law.

  2. The contest has two parts: (A) “IT Girl” and (B) “Public Vote”.
    (A)“IT Girl”
    For a chance to be chosen as the IT GIRL, visit the contest site at www.louloumagazine.com, complete the entry form in full, attach a photo of yourself, and send it all as per the instructions before 11:59 p.m. on March 20, 2009. The photo submitted must be from the waist up and sent as a JPEG file not exceeding 1 Mb. Limit one (1) IT GIRL entry per individual/e-mail address.

    By submitting a photo (the "Photo") as part of the contest, the entrant guarantees and declares that she owns the Photo submitted. The entrant authorizes the contest sponsors to distribute the Photo and declares owning all copyrights to it, including publication and duplication rights. The entrant releases the Contest Sponsors from any lawsuits or damages resulting from the distribution of the Photo on the Web sites of all the Contest Sponsors and (or) in any other medium. All Photos and entries submitted become the property of the Contest Sponsors, who reserve the right to refuse any Photo submission or entry.

    A jury will select 15 finalists (the "Finalists") among all the entries received. The Finalists must then prepare, at their own cost and expense, a short personal video of themselves filmed in a Smart Set store, strutting their "Smart Set look." The Finalists' videos will be posted online at louloumagazine.com starting on April 24, 2009.

    By submitting a video (the "Video") as part of the contest, the entrant guarantees and declares that she owns the Photo submitted. The entrant authorizes the contest sponsors to distribute the Video and declares owning all copyrights to it, including publication and duplication rights. The entrant releases the Contest Sponsors from any lawsuits or damages resulting from the distribution of the Video on the Web sites of all the Contest Sponsors and (or) in any other medium. All Videos and entries submitted become the property of the Contest Sponsors, who reserve the right to refuse any Video submission or entry.

    (B)“Public Vote”
    From April 24 to May 21, 2009 (the "voting period"), the public will be asked to vote for their favourite "IT GIRL" among the Finalists. Limit one (1) vote per individual and email address per day during the voting period.
    Voting will give access to the entry form to participate in the weekly draws for Smart Set gift certificates but one (1) entry per person per “week” in the voting period will be accepted. A “week” being defined from Friday, noon (12h00 pm) until 11h59 am the next Friday.

  3. Prizes and awarding/drawing of prizes
    (A)“IT Girl”
    The four (4) Finalists with the most public votes at the end of the voting period are eligible to win one (1) of four (4) Smart Set wardrobes, which will be awarded in the form of Smart Set gift cards for $3,500 each and are not redeemable for cash. In the event of a tie between Finalists, a random draw will be made by a representative of Rogers to determine the winner no later than May 29, 2009. The four Finalists thus determined will be notified by telephone and/or e-mail.

    (B)“Public Vote”
    Those participating in the public vote are eligible to win one of eight Smart Set gift cards for $125 each, which are not redeemable for cash.

     A random draw by a representative of Rogers Publishing Limited ("Rogers") the Contest Sponsor as represented from all entries received will be made twice a week at noon on May 8th, May 15th, May 22nd and May 29th 2009 in the offices of LOULOU magazine located at 1200 ave McGill College, suite 800, Montréal, Qc, H3B 4G7. Selected entrants will be contacted by telephone or email, as set out on the entry form.

  4. If a selected entrant cannot be reached within 5 days following the draw, incorrectly answers the skill-testing question, declines the prize, or fails to return a Release of Liability as specified below, another entrant will be selected.

  5. Prizes must be accepted as awarded and may not be transferred or exchanged or combined or used in concert with another contest or another offer. No rebates or Smart Set member points can be applied in relation to the prizes won. Contest Sponsors reserve the right to substitute a prize of at least equal value in the event of the unavailability, for whatever reason, of the advertised prize. Prizes must be accepted as is and cannot be converted in cash or for another prize. Products bought with the prize cannot be returned once the prize has been claimed. The choice of sizes and colors offered is the one that is available. No  rain check will be supplied.

  6. Contest Sponsors reserve the right to verify if contest winners satisfy to all contest admissibility criterias. To be declared a winner, selected entrants must first correctly answer, unaided, a time-limited, mathematical skill-testing question posed by telephone at a mutually convenient time; and may also need to return a signed release of liability and acknowledgment form. Contest judges' rulings are final and without appeal in all matters related to the promotion and the awarding of prizes.

  7. By entering this Contest, entrants consent to the use of their entry, name, city of residence and/or any photograph of or that may be taken in publicity carried out by the Contest Sponsors and their advertising agencies, without further notice or compensation.

  8. This Contest is open to residents of Canada who are over the age of majority in their province or territory of residence excluding employees of Smart Set, LOULOU, Rogers Publishing, its parent and affiliated companies, representatives, dealers and agents, Contest suppliers and judges, and those with whom they are domiciled. The Contest is subject to all applicable federal, provincial and municipal laws and regulations.

  9. No communications will be entered into except with selected entrants. To obtain the list of the winners, visit www.louloumagazine.com after contest closing date.

  10. Odds of winning depend on the number of eligible entries. All entries that are incomplete, illegible, damaged, irregular, that have been submitted through illicit means, or do not conform to or satisfy any condition of the rules may be disqualified by the Contest Sponsors. Contest Sponsors take no responsibility for lost, stolen, delayed, damaged, misdirected, late or destroyed entries, or for typographical or other production errors. Contest Sponsors are not responsible for any errors or omissions in printing or advertising this Contest. All entries become the property of Contest Sponsors and will not be returned.

  11. Contest Sponsors are collecting personal data about entrants for the purpose of administering this Contest. No further informational or marketing communications will be received by entrants unless entrants provide Contest Sponsors with explicit permission to do so as indicated on the entry form. Please see Rogers’ Privacy Policy at www.rogers.com  and www.smartset.cafor information on their policies towards maintaining the privacy and security of user information.

  12. By entering this Contest, entrants release and hold harmless Contest Sponsors, their advertising and promotional agencies and the Contest judge(s), their affiliates and respective directors, officers, owners, partners, employees, agents, dealers, representatives, successors and assigns (collectively the “Releasees”) from any liability in connection with this Contest or, if declared a winner, the prize. Before being declared a winner, entrants may be required to sign and return, within a stipulated period of time, a Declaration of Compliance with the Contest Rules and a full Liability and Publicity Release. By accepting a prize, winners consent to the use of their name, place of residence, voice, statements, photographs or other likenesses for publicity, advertising or informational purposes in any medium or format without further compensation or notice.

  13. This Contest will be run in accordance with these rules, subject to amendment by Contest Sponsors. Contestants must comply with these rules, and will be deemed to have received and understood the rules by participating in the Contest. The terms of this Contest, as set out in these rules, are not subject to amendment or counter-offer, except as set out herein.

  14. (a) Contest Sponsors assume no responsibility for failure of the internet or the website during the promotional period, for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any email or traffic congestion on the internet or at any website, or any combination thereof including any injury or damage to an entrant’s or any other person’s computer related to or resulting from playing or downloading any material in the promotion. Contest Sponsors reserve the right, in its sole discretion, to cancel or suspend the email portion of this Contest should a virus, bug or other cause beyond their reasonable control corrupt the security or proper administration of the Contest. Any attempt to deliberately damage any web site or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws. Should such an attempt be made, the Contest Sponsors reserve the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
    (b) If the identity of an entrant is disputed, the authorized account holder of the e-mail address submitted at the time of entry will be deemed to be the entrant. The individual assigned to the e-mail address for the domain associated with the submitted e-mail address is considered the authorized account holder. A selected entrant may be required to provide proof that he/she is the authorized account holder of the e-mail address associated with the selected entry. All entries must be submitted from a valid e-mail account that may be identified by reverse domain name search. The sole determinant of time for the purposes of receipt of a valid entry in this Contest will be the Contest server machine(s).

  15. For Quebec residents. Any litigation respecting the conduct or organization of a publicity Contest may be submitted to the Régie des alcools, des courses et des jeux du Québec for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties to reach a settlement. Any applicable decision to be made by Contest Sponsors affecting the conduct of this Contest are subject to a ruling of the Régie des alcools, des courses et des jeux du Québec.
